This website contains information regarding the proposed development of a luxury, branded, waterfront hotel and resort located on approximately 6.2 acres at Rokers Point, Great Exuma, The Bahamas (the "Project"), and regarding Waterside Developments Limited ("Waterside") and its affiliate: Waterside Properties Limited (the "Affiliate"). Waterside and the Affiliate are sometimes hereinafter together referred to as the "Company."

  

Neither Waterside nor the Affiliate nor their respective directors, officers, employees, advisors, agents or managers, nor any member of the Project team of the Company has any duty of care or other responsibility to any user of this website or any other third-party.

 

Neither the Company nor any of its representatives expects to update or otherwise revise this website or any content and, as such, information contained in this website may be superseded or changed as the Project is progressed or changes occur.

 

This website contains certain statements regarding conceptual plans for the resort, proposals and ideas for a new beach and beach facilities and for water sports and water activities and other facilities which the Company is considering providing or procuring for future guests or other parties at the resort (together the “activities”). Some of these plans, proposals and ideas will require the entering into by the Company of formal legally binding agreements with relevant third parties and, whilst this website assumes that the Company will or may successfully negotiate the terms of and execute any such formal agreements, that cannot be guaranteed. In addition, before these plans, proposals and ideas can be implemented, the Company and its management and Project team will need to undertake further due diligence and analysis and, where relevant, seek specialist advice regarding (i) the estimated demand for the provision of the activities (ii) the practical and financial viability of providing some or all of the activities (iii) how the provision of each of the activities will be funded (iv) the ongoing viability of each of the activities and (v) what Government permits or other licenses and approvals will be required in connection with the provision of any of the activities. Pending completion of such due diligence and analysis and the obtaining of any such specialist advice and any necessary permits licenses or approvals to the satisfaction of the Company, no decisions will be made by or on behalf of the Company as to whether any or all of the activities can and will be provided at the resort (when completed). As such, none of Waterside, the Affiliate or their respective directors, officers, employees, advisors, agents, or managers nor any member of the Project team of the Company gives any assurance or undertaking regarding the provision of any of the activities nor owes any duty of care or other responsibilities to any user of this website regarding the activities or their provision at the resort.
